rules by age group

rear-facing (birth – 6 months)

babies must be in a rear-facing restraint from birth until at least 6 months old. children under 4 can remain rear-facing if their restraint supports it.

forward-facing with harness (6 months – 4 years)

children aged 6 months to under 4 years must use a rear-facing or forward-facing restraint with an internal harness.

booster seat (4 – 7 years)

children aged 4 to under 7 years must use a forward-facing child restraint with harness or a booster seat.

seatbelt only (7+ years)

children aged 7 and over can use an adult seatbelt alone, but a booster seat is recommended until the seatbelt fits correctly (around 145cm tall).

front seat rules

children under 4 must not travel in the front seat of a vehicle with two or more rows. children aged 4 to under 7 cannot sit in the front unless all rear seats are occupied by children under 7.

taxis and ride-share

children under 12 months must not travel in the front row of a taxi. children aged 1–7 can travel in the back of a taxi without a restraint if one is not available, but must wear a seatbelt.

NSW specific notes

  • all child restraints must comply with the Australian Standard AS/NZS 1754
  • it is the driver's responsibility to ensure all passengers under 16 are correctly restrained
  • you can get your child restraint professionally fitted — search for an authorised fitting station near you
